9ll terrorist attacks = Significant changes to authority of Foreign Intelligence Surveillance Court (FISC) (Section 215) to order “RELEVANT…tangible things including books, records, papers, documents, and other items” be turned over to the government for an investigation intended to protect the nation “against international terrorism.”

Section 215 essentially extended the traditional subpoena power of FISC to the foreign intelligence context and classified matters.

Section 215 = Enabled GOV to direct credit card company or phone companies to provide records of an individual reasonably believed to be planning or participating in terrorist activities.

May 2006 = FISC adopted a much broader and unprecedented interpretation of section 215 = that allowed collection of bulk telephony meta-data.

FISC judges later issued orders directed phone companies to turn over “on an ongoing daily basis,” huge quantities of telephone meta-data of millions of Americans not suspected of anything and retained for five years.

NSA said call records were “vital to NSA’s counterterrorism intelligence” to “continuously keep track of” the activities, operatives, and plans of specific foreign terrorist organizations who “disguise and obscure their communications.”

FISC said NSA can legally access telephony meta-data if “there are facts giving rise to a reasonable, articulable suspicion” (RAS) that a particular telephone number “is associated with” a foreign terrorist organization. NSA in 2012 did 288 queries to get a list of every telephone number that either called or was called by the seed phone number in the past five years and then query that list for more numbers linked to them – possibly including 10’s of thousands of people.

NSA claims the 288 queries resulted in a total of 12 “tips” to the FBI. The NSA reports that, on at least a few occasions, the tips helped prevent possible terrorist attacks, but the Review Group concluded it had not prevented any planned terrorist attack since inception in 2006.

Government’s arguments for the meta-data program with Review Group’s analysis:

GOVERNMENTS 4 ARGUMENTS FOR BULK META-DATA:

1. Important tool to discover a suspected terrorist contacts other possible terrorists in USA – Amazingly they claim they could have prevented 9ll.

REVIEW FINDING: In fact, meta-data generated relevant information in only a small number of cases, and there has been no instance in which NSA could prove it HELPED. Reason for program – potential terrorists did not know it existed, but now they do so, the Review Group concluded that it is not critical to protecting the national security.

2. Bulk telephony metadata does not intrude on individual privacy – Amazingly nobody told them to stop a program few knew existed and heck the phone company has it so people cannot expect privacy.

REVIEW FINDING: Too much! Peoples’ “decision to reveal otherwise private information to such third parties does not reflect a lack of concern for the privacy of the information, but a necessary accommodation to the realities of modern life….they want and expect the ability to use such services and the right to maintain their privacy when they do so….There is no reason why that should not be possible.

3. Mere calling data does not reveal anything particularly private since call itself is not kept.

REVIEW FINDING: We noted that “the record of every telephone call an individual makes or receives over the course of several years can reveal an enormous amount about that individual’s private life” – individual’s ‘familial, political, professional, religious, and sexual associations.’ – can seriously chill ‘associational and expressive freedoms’ – can significantly undermine public trust, exceedingly important to the well-being of a free and open society.” We concluded that the limitation of the program only to telephone meta-data did not eliminate potentially serious concerns about individual privacy.

4. NSA claims data is safe and protected from any improper use.

REVIEW FINDING: There “is always a risk that the rules, however reasonable in theory, will not be followed in practice” – despite careful safeguards, there had in the past been serious issues of unintentional noncompliance in the use of telephony meta-data program – many different kinds of abuse – “we cannot discount the risk, in light of the lessons of our own history, that at some point in the future, high-level government officials will decide” that this database “is there for the plucking” – the Church Committee noted surveillance abuses of the 1960s and 1970s – threatens to chill the exercise of First Amendment rights, and is inimical to the privacy of citizens.”

GOV says the bulk telephony meta-data program stops terrorist without invading individual privacy and should be retained.
