Christie’s Supreme Court Packing with His GOP Judges – TO PRIVATIZE EDUCATION = VIOLATES THE CONSTITUTION AND SEPARATION OF POWERS
NJ Constitution = Requires STATE GOV to offer a “thorough and efficient” education for all of the state’s school-age children.
NJ Supreme Court ruled (1973) this obligation was not satisfied by a school-funding system that relied primarily on local property tax revenue. = Discriminated against students in urban districts with fewer resources. = Court ordering more funding from the state for the poorer districts. GOP criticized the court for “actively enforcing the STATE CONSTITUTION.” Finally resolved AND THEN ALONG CAME CHRISTIE!
Gov. Christie (R) first budget slashed funding for URBAN education = SUPREME COURT ruled that these cuts violated the state constitution, and reimposed its remedial order for more funding for the poorer schools. = CHRISTIE Cuts were “real, substantial, and consequential blow to the right to the achievement of a thorough and efficient system of education.”
Christie responded by arguing the court should not “determine what programs the state should and should not be funding,” despite the language in the state constitution. Christie pledged to “reshape” the court (FOR GOP) and in 2010 threw a respected justice off the bench by denying him tenure. = NEVER INTENDED AS A POWER OF THE GOVERNOR! = Violated traditions that ensured high court’s independence.
